General terms and conditions for flats, houses and flats Dear guests!

Before you rent flats or flats, you should take the time to read these rules!

As we all know the importance of a successful contract today, we have tried to create all the necessary conditions. This also includes clear legal regulations based on travel and payment terms. For the rental of a flat / condo, a booking confirmation is attached.

§ 1 object of the lease and key

1.1 The landlord leases to the tenant named in the enclosed binding booking confirmation the designated accommodation for the period of time stated in the confirmation and the number of persons stated.

1.2 The rental property is fully furnished.

1.3 In the event of unsatisfactory cleaning, the guest shall be entitled to have the defect rectified if they notify the property manager without delay.

1.4 The tenant receives 1-2 door keys / keys to the flat for the duration of the rental.

§2 rental period, arrival and departure

2.1 The rental property shall be rented to the tenant during the time specified in the binding booking confirmation.

2.2 The rental property may be received on the day of arrival between 4:00 p.m. and 10:00 p.m. If arrival is between 22:00 and 08:00 by prior arrangement and takes place during this time, a fee of EUR 30.00 will be charged.

2.3 Early or late arrival times must be agreed in advance with the owner/manager. Please note that due to cleaning or departure, there may be occasional delays in receiving your holiday home.

2.4 On the day of departure the tenant will leave the flat before 11:00 am.

2.5 If you wish to stay longer on the day of departure due to a late return flight, please arrange this with the receptionist on site.

§ 3 Rental price and method of payment

3.1 The full cost of the rental is shown on the booking confirmation attached.

3.2 At the end of the rental period, the tenant will vacate the property in good condition to hand over the keys to the landlord/manager or leave the property as directed by the landlord/manager.

3.3 The amount is to be paid as follows: an initial deposit of 25% is to be paid by PayPal or credit card. The balance is payable four weeks before check-in in the same way via PayPal or credit card. If the time between the start of the trip and confirmation of the booking is shorter than four weeks, the entire amount must be paid immediately. If the tenant does not have a down payment or final payment by default, the landlord has the right to terminate the contract without further notice and to surrender the object for further rental without further notice.

3.4 Pets. The accommodation of pets requires the prior consent of the landlord. The tenant is responsible for all damage caused by animals.

3.5 Smoking. Please note that this is an allergy-friendly house, so smoking is not permitted inside the rooms.

§ 4 Cancellation and cancellation of stay

4.1 If a tenant cancels (terminates) the contract prior to the commencement of the tenancy without specifying a new tenant who enters into the contract under the same conditions, a certain percentage will be charged (except for final cleaning) see below.

4.2 If no notice is received and the tenant does not arrive, the same conditions apply. It is advisable to take out travel termination/cancellation insurance.

If you cancel before the 55th day before renting 25%

If cancelled between the 54th and 35th day before hire 50%

In case of cancellation from the 34th to the 15th day before the rental date 75%

In the case of withdrawal from the 14th day before the rental date 100% of the total cost.

However, the landlord makes every effort to surrender the property to another person.

4.3 If the tenant terminates the stay prematurely, he is still obliged to pay the full rental price.

4.4 Cancellation or termination may only be made in writing. The day on which the declaration is received by the landlord is decisive. Contact information can be found on our letterheads as well as on our website.

§ 5 Responsibilities and obligations of the lessee

5.1 The rental property, including furniture and other objects in it, must be used with care. The tenant shall notify persons accompanying and/or visiting him of the care of the property.

5.2 The tenant shall be liable for damage to the rental property, furniture or other objects in the rented premises by him/her or his/her accompanying persons. If the key is lost, the cost of replacement must be reimbursed. If it is a master key, a lump sum payment of EUR 200 is required.

5.3 Any damage found must be handed over immediately to the landlord or administrator.

5.4 If the tenants cause damage to the building or furniture, the damage must be reimbursed.

§ 6 Written form, severability clause

6.1 If individual provisions of these terms and conditions should be invalid or unenforceable or become invalid or unenforceable after the conclusion of the contract, this shall not affect the validity of the remaining part of the contract. An ineffective or unenforceable provision shall be replaced by an effective and enforceable provision whose effect comes as close as possible to the economic purpose pursued by the contracting parties with the ineffective or unenforceable provision.

§ 7 Jurisdiction

7.1 The place of jurisdiction for all disputes between the parties resulting from the contractual relationship shall be the City of Gütersloh. German law shall apply.
